Nissan Data Breach Settlement: What You Need to Know and How to Claim Your Share

Settlement Overview: CAD $1.82 Million Fund for Class Members

In the wake of a 2017 data breach, Nissan Canada Inc., Nissan Canada Financial Services Inc., and Nissan North America, Inc. faced class action lawsuits in Ontario and Quebec. These suits allege that an anonymous attacker demanded a ransom after claiming possession of customer data. Although Nissan denies any wrongdoing, the parties reached a settlement to resolve the claims.

Under the approved settlement, Nissan will provide a CAD $1.82 million fund to compensate eligible class members who submit claims for losses tied to the data breach.

Who Is Eligible to Participate?

The settlement distinguishes between members of two groups:

  1. Quebec Action Members:
    • Residents of Quebec with an active lease or loan with Nissan between December 22, 2016, and January 12, 2017.
    • Quebec residents notified by Nissan via letter in January 2018 about the incident.
  2. Ontario Action Members:
    • Residents across Canada (excluding Quebec) with active leases or loans with Nissan during the same timeframe.

Claim Categories and Compensation

Class members can file claims under two options:

  1. Documented Claims:
    • Compensation of up to CAD $2,500 for those with documented damages, costs, or expenses directly tied to the breach.
    • Requires proof of class membership and detailed documentation of damages.
  2. Undocumented Claims:
    • Reimbursement of up to CAD $35 for individuals without proof of damages but who establish membership in the settlement class.
