Desjardins has agreed to a $200.8 million class action settlement to resolve allegations that the company failed to protect sensitive customer information during a 2019 data breach. This breach exposed the personal and financial data of approximately 9.7 million Canadians.

What Happened?
A rogue employee at Desjardins reportedly accessed sensitive consumer information over two years, compromising data including names, social insurance numbers, dates of birth, phone numbers, and banking details. Following an investigation, Canada’s privacy commissioner determined that Desjardins failed to demonstrate proper care in protecting customer data.
Although Desjardins has not admitted fault but agreed to pay the settlement compensation for affected members.
Who is Eligible?
The settlement benefits two groups of current and former Desjardins members in Canada:
- Subclass 1: Members who experienced lost time due to the breach.
- Subclass 2: Members who suffered identity theft or fraud due to the breach.

Settlement Details
- Lost Time Compensation: Eligible members can claim up to 5 hours of lost time at $18/hour, with a maximum payment of $90.
- Identity Theft Payment: Those affected by fraud or identity theft can claim a one-time payment of $1,000.

- Subclass 1: Deadline passed on April 20, 2023.
- Subclass 2: Yearly claim deadlines include:
- Oct. 20, 2023 (Year 1)
- Oct. 20, 2024 (Year 2)
- Oct. 20, 2025 (Year 3).

- Subclass 1: Claims under three hours require no documentation. Claims over three hours must include descriptions of compensable actions.
