TD Bank Faces Class Action Lawsuit Over Massive Data Breach: Customers’ Private Information at Risk

A newly filed class action lawsuit accuses TD Bank of failing to properly secure and safeguard its customers’ personally identifiable information (PII) during a significant data breach in 2023. The lawsuit, brought forth by plaintiff Robert Taylor, alleges that an employee at TD Bank improperly accessed sensitive customer information between May and October 2023 and may have shared it with an unauthorized third party.

According to the lawsuit, the compromised data includes highly sensitive personal details such as:

Delayed Notification Sparks Outrage

One of the most troubling allegations in the lawsuit is that TD Bank failed to notify affected customers in a timely manner. Taylor claims the bank was aware of the breach but did not disclose it until February 2025—months after the unauthorized access had occurred.

“Representative Plaintiff and Class Members were wholly unaware of the Data Breach until they received letters from Defendant informing them of it,” the lawsuit states, arguing that this delay in notification deprived customers of the opportunity to take proactive steps to protect themselves.

The class action lawsuit brings forth multiple legal claims against TD Bank, including:

  • Negligence: Failing to implement adequate security measures to protect customer data.
  • Breach of Implied Contract: Failing to uphold its obligation to protect customer information.
  • Breach of Good Faith and Fair Dealing: Neglecting to act in customers’ best interests by delaying breach notifications.

Taylor is demanding a jury trial and seeking declaratory and injunctive relief, along with actual, nominal, and consequential damages for all affected class members.

TD Bank’s Troubled History with Consumer Protection

This is not the first time TD Bank has faced scrutiny over its handling of consumer data. In 2024, the Consumer Financial Protection Bureau (CFPB) imposed a $28 million fine on the bank for allegedly reporting inaccurate consumer account information to credit reporting agencies.
